UAE Ministry of Finance Announces Schedule of Administrative Penalties for Corporate Tax Violations

The UAE Cabinet has issued a new decision covering tax procedure, penalties & exemptions. As per the Cabinet Decision No. (75) of 2023, An administrative penalty will now be imposed by the Federal Tax Authority (FTA) for violations related to corporate tax law.

The administrative penalties are effective from August 1, 2023

Key features:

1. Penalties will be applied on taxable persons, whether an individual or a legal entity, not complying with the corporate tax law.

2. Penalties will be applied in cases of failure to file and pay corporate tax due on time

3. Applies on failure of the registrant to inform the Federal Tax Authority of any case that may require the amendment of the information pertaining to his tax record kept by the Federal Tax Authority.

4. Penalties also apply in cases of failing to properly keep records or submitting the required records and other information specified in the tax law.

5. A new structure has also been introduced for voluntary disclosure penalties.
